Am I Eligible to Pursue Workers’ Compensation Benefits?
Most employers in Arizona are required to purchase workers’ compensation insurance to cover workers, including part-time workers, who get hurt on the job. However, the workers’ compensation system does not apply to independent contractors, in-home domestic workers, and small business owners.
If you are an independent contractor, your employer may have misclassified you to avoid having to pay for benefits. There are several factors that our attorneys may consider to determine if you should be classified as an employee instead of an independent contractor:

- Who supplies your equipment and tools?
- Does an employer supervise your work?
- Who controls how the job will be completed?
Your employment status is one factor in your eligibility for benefits. You must also have suffered an injury or illness related to your job. In other words, you should have been engaged in work-related activities.
Generally, the injury must have happened at your workplace, although there are some exceptions where offsite injuries may be covered.

What Types of Benefits are Available with the Help of Lake Havasu City Workers’ Compensation Lawyers?
There are several types of benefits you may be eligible to obtain depending on the severity and extent of your injury:
Temporary Partial Disability (TPD)
These benefits are paid to workers who can work, but not in the same capacity as before. However, the worker’s limitations are only temporary. During this period of temporary disability, the worker may be eligible for two-thirds of the difference between the wage he or she currently earns and the wage he or she used to earn before the injury.
Temporary Total Disability (TTD)
These benefits are provided to employees whose injuries last more than eight days. These workers must also be unable to return to their regular jobs while they recover. Workers who are eligible for temporary total disability may receive 66 and two-thirds percent of the monthly wages they earned before their injury.
Permanent Total Disability (PPD)
If the injured worker suffers a 100 percent loss of earning capacity because of a permanent injury, he or she may be eligible to obtain 66 and two-thirds percent of his or her average monthly wage.
Permanent Partial Disability (PTD)
If an injured worker reaches maximum recovery but can no longer work in the same capacity as he or she did before the accident, the worker may be eligible to receive 66 and two-thirds percent of his or her average monthly wage up to a maximum of $3,000. Weekly payments cannot exceed $460.
Death Benefits
In the unfortunate event that a workplace accident takes the life of an employee, the employee’s surviving family or beneficiaries may receive death benefits to cover the costs of funeral and burial expenses. The surviving family may also receive 66 and two-thirds percent of the deceased worker’s average monthly wage.
The workers’ compensation system also covers reasonable medical expenses for the treatment of the worker’s injury. Unfortunately, your employer has the right to choose the doctor you see on your first visit. After that, you can choose the doctor you see.

Getting Injured in an Offsite Accident
Generally, a work accident must happen in the workplace to be eligible for benefits. However, there are times when an offsite accident may be covered.
These claims can be complicated, and the victim has the burden of proving his or her injuries occurred while performing work-related tasks. Examples of this may include:
- Getting injured while traveling for work-related purposes
- Experiencing a traffic accident while on business
- Falling from stairs while on company property

How Long Do I Have to Report My Injuries?
If you have been injured on the job, you only have one year from the date of the injury to file a workers’ compensation claim with your employer’s insurance.
It is also important that you report the accident to your employer as soon as possible. It is the employers’ responsibility to file an accident report. For a non-fatal accident, your employer is required to file a report to the Industrial Commission of Arizona. For fatal accidents, the employer must report it to the Arizona Division of Occupations Safety and Health (ADOSH) within eight hours.
Other severe accidents that require hospital rehabilitation, such as accidents resulting in eye loss or amputation, must be reported to ADOSH within 24 hours.
Steps to Take After a Workplace Accident
After experiencing a workplace accident, you may be confused about what to do next. There are a few steps you can take to help protect your health and your potential claim:
- Seeking medical attention — Your health is your top priority after an accident. You need a doctor to examine you to diagnose your injuries, stabilize them and begin treatment. There are multiple hospitals in the area where you can go for treatment, including Havasu Regional Medical Center and Kingman Regional Medical Center. Seeking treatment soon after the accident helps to establish a strong link between the accident and your injury, which can help strengthen your workers’ compensation claim.
- Reporting the accident — It is important to report the accident to your employer so they can begin the workers’ compensation process. The sooner the process begins, the sooner you may receive benefits.
- Gathering documentation — Keep track of all documentation regarding your accident. This may include medical records that connect your injuries to the accident or police reports. You may also begin collecting your own evidence by taking pictures of the scene of the accident and your injuries.

What if My Claim is Denied?

Two family members were in a bad wreck a couple of years ago, and as a result called Phillips Law to represent them. Montana Thompson was the attorney assigned to the case with the help of Nemo Farr as legal assistant. Mr. Thompson litigated a very generous settlement for both my stepdaughter and her son. Because my grandson is a minor, I decided to act as conservator for him to ensure the settlement was safe and secure.
