Are Verbal Agreements Legally Binding?
Under Arizona’s Statute of Frauds, certain types of agreements must meet a specific set of criteria in order to be enforced by the court. There must be some form of written memorandum of the agreement. However, this does not mean that the agreement in its entirety has to be in writing.
In the event an agreement falls outside these guidelines, it may still be enforceable, but the burden of proof will generally lie with the party that is requiring these terms of agreement to be met, or by someone authorized by the party to sign on his or her behalf.
