Do I Have a Case Over My Scooter Accident Injury?
Generally, our lawyers must determine if your injury resulted from another’s negligence, such as the negligence of a scooter manufacturer, rental company, driver, pedestrian or another party.
Negligence is a complex legal theory that involves four elements. If you allow our attorneys to review your situation, we will need to determine if we would be able to prove all four elements, including:
Duty of Care
Did the at-fault party have a legal obligation to take reasonable steps to prevent you from suffering an injury?
Drivers have a duty to obey traffic laws and watch for pedestrians and people on scooters.
Breach of Duty of Care
We need to prove how the at-fault party failed to uphold the duty of care, such as by distracted driving, speeding, violating right-of-way laws, or building a defective or dangerous product.
Breach is Directly Linked to Your Injuries
The breach of duty must be the direct cause of your injuries, and your injuries would have otherwise not occurred.
Damages were Suffered
Your injuries must have led to physical, financial or emotional damages.
Unsure if you may have a valid case? That is why meeting with an experienced Avondale scooter accident attorney can be an important step to take.

Scooter Accident Liability
Roads or sidewalks that were improperly maintained could be the cause of a scooter accident. In this situation, the government entity responsible for the sidewalk could hold liability.
However, there are many kinds of scooter accidents and liability could be spread among a few parties. Pedestrians may have failed to pay attention and walked into a scooter’s path, causing the rider to crash into something or someone else.
Drivers who hit scooter riders could also be at fault if they were disobeying traffic laws and the scooter rider was obeying the law at the time of the crash.
Product manufacturers may be exposed to liability if a defect on the scooter caused the rider to fall off or lose control and crash. Retailers and designers could also hold liability for this kind of accident.
The company that rented the scooter could be held liable for failing to maintain the vehicle in a safe condition.
In an accident with a pedestrian or vehicle, the scooter rider could also be held fully or partially liable.
As liability is a complex issue, discussing the situation with an experienced Avondale scooter accident lawyer may be helpful.
Damages That May Available in an Injury Claim
Our attorneys may be able to pursue these types of damages on your behalf, if we are able to validate your claim:
- Surgery
- Hospital stays
- Emergency room visits
- Prescription medications
- Follow-up visits with doctors
- Physical therapy
- Rehabilitation
- Lost wages
- Lost earning capacity
- Loss of companionship
- Lost enjoyment of life
- Pain and suffering
The value of a claim depends on the severity of injuries and how long those injuries may affect the victim, among other factors.
Damages could also be affected by the victim’s percentage of fault. If you are found to bear a certain amount of liability, your final award will be reduced based on your percentage of fault. That means an award of $100,000 becomes $60,000 if you are 40 percent at fault.
For example, you could share liability if you were riding the scooter too fast given the number of pedestrians on a sidewalk.
Phillips Law Group is available to discuss the value of your claim and how partial fault could affect your final award.

How Much Time do I have to File a Claim?
Generally, personal injury victims have two years to file a claim for compensation against a private entity or citizen. That means if you do not file a claim before two years passes, you may lose the right to do so. This is explained in Arizona’s personal injury statute of limitations.
There are exceptions, such as for claims against the government. You must provide notice to the government entity within 180 days of the accident.
This is a complex issue you can discuss with one of our experienced Avondale scooter accident lawyers in a free consultation.

Arizona Regulations for Scooters
One of the important issues to consider in a scooter accident claim is how the scooter is classified under state law. Arizona established specific definitions for different kinds of scooters and mopeds in Senate Bill 1398, passed in April 2019.
An electric miniature scooter is one that fits the following criteria:
- Weighs less than 30 pounds
- Cannot go more than 10 miles per hour
- Has an electric motor or is operated under human power
- Two or three wheels at maximum
- Riders can stand on a floorboard while riding
- Handlebars
Electric standup scooters have many of the same features as miniature scooters, except they can weigh up to 75 pounds and go over 20 miles per hour.
Any scooter that does not fit these criteria may be considered a moped under Arizona law. Whereas scooters do not need insurance or registration, mopeds need to be registered with the state, with a unique identification that can be seen from at least five feet away.
Any scooter that goes faster than 25 miles per hour is considered a motorcycle. There are more regulations for motorcycles than for mopeds or scooters, including helmet requirements and insurance and licensing requirements.

Positive: Professionalism, Quality, Responsiveness, Value As someone who is familiar with the inner workings of the auto insurance industry I can whole heartedly endorse Steven J. Jones and Phillips law group as someone I would want on my side should litigation take place. They handled my case professionally, honestly, and with satisfactory results which I would not have expected without enlisting their help.

I’ve been working at Phillips Law Group for nearly four years and I can confidently say this is the best personal injury firm in Arizona to work for. The firm is the best for numerous reasons but to start, Phillips Law Group gives employees opportunities for promotions and growth. I started working within the settlement department, moved to a paralegal assistant and grew to be a pre-litigation paralegal with my own case load. Each attorney I have worked for is extremely knowledgeable, friendly, and easy to talk to. Secondly, I love how Phillips Law shows appreciation for employees. They host Friday Zoom Huddles giving out PTO, goodie bags, special shout outs, bonuses and gift cards. They also host extravagant holiday parties and fun contests during the Holidays! Lastly, the firm cares about giving back to the community, which is a trait I value as well. It’s rewarding to see a fast paced firm taking time out of their busy day to pay it forward. I would highly recommend working at Phillips Law Group!

My review is for Kathy Hudson a legal assistant at the law firm. She is great! She is very professional and a fair based person. She was never rude to me and always called me back. She listened to me and had my best interest as number 1. Mr Nasir who is a supervisor at law firm also was very professional and helpful. Not sure if spelling his name correctly but sorry if not. As far as mr Ross and the lady that runs the front desk reception I would say they are the most unprofessional and rude people I have met at a law firm in my life especially beings they were representing me. But Kathy made it overall a better experience. Thx Kathy.
