- Common Driver Distractions
Due to many technological advances, distracted driving on Arizona roadways is becoming a bigger problem than ever. In fact, driving while distracted is one of the leading causes of Phoenix auto accidents.
A driver distraction can be defined as any attention given to a non-driving-related activity while operating a motor vehicle, typically to the detriment of driving performance.
If you have been involved in an auto accident caused by a distracted driver, you may be eligible to pursue legal recourse for your losses. Complete the form on the right to schedule a no-obligation consultation with an experienced distracted driving attorney.
Common Driver Distractions
Distractions can be separated into three categories:
- Visual distractions take the drivers eyes off the road.
- Cognitive distractions take the drivers mind off the road.
- Manual distractions take the drivers hands off of the steering wheel.
Oftentimes, a distraction involves a combination of these categories. Some of the most common forms of driver distractions include:
- Cell phone use, including answering the phone, talking on the phone, dialing a phone number and texting.
- Talking to a passenger within the vehicle.
- Reaching for an object inside the car.
- Using a GPS.
- Applying makeup.
- Having a pet in the vehicle.
- Eating or drinking.
- Manipulating radio controls or using portable music devices.
- Looking at something outside of the car, such as a billboard or an accident (also known as rubbernecking).
Distraction Statistics
According to a study conducted by the National Highway Traffic Safety Administration (NHTSA) and the Virginia Tech Transportation Institute (VTTI), 80 percent of all crashes and 85 percent of near-crashes involve some type of driver distraction.
Cell phone use is, by far, the most common driver distraction. At any given moment during typical daytime hours, as many as 10 percent of drivers are using a cell phone.
In 2018, according to ADOT, 45% of Arizona’s crashes were caused by distracted drivers.
Distracted Driver Prevention
Cell phone use is one of the top driver distractions. If you absolutely must use a cell phone while driving, use the following tips in order to avoid causing a wreck:
- Assess traffic conditions before using your phone. Avoid talking on the phone in bad traffic or inclement weather.
- Use speed dial if possible.
- Dial the number when the vehicle has stopped moving or, if possible, have a passenger dial for you.
- Keep your phone within reach.
- Use either a hands-free device or speaker phone.
While these tips are helpful if you must use a cellphone, the best way to avoid driver distraction is to eliminate cell phone use altogether while behind the wheel.
The following tips will help you to avoid common driver distractions:
- Allow yourself enough time to stop, rest from driving and eat a meal, rather than eating while behind the wheel.
- Buckle up children and give them things to keep them entertained, such as books, games or other car-appropriate toys to occupy them while driving.
- If children are misbehaving, pull over.
- If driving with a pet in the car, properly secure them in a pet carrier or pet harness. Never allow them to sit in your lap while you are driving.
- Adjust vehicle controls either before you leave or when you are at a full stop.
- Do not check e-mail, voicemail or other portable devices once you have begun driving.
- If there are passengers in the vehicle, ask them to adjust the radio, climate control or navigation system for you.

Distracted drivers are a danger to everyone on the road, including other drivers, bicyclists and pedestrians. With our ability and tendency to multi-task, auto accidents caused by driver distractions are becoming more and more commonplace.
The insurance company that represents a distracted driver will typically try to limit or deny your claim of injury by stating that you had some degree of fault in causing the accident. An experienced auto accident attorney can recreate the scene of the collision in order to prove that distraction was a reasonable cause for the crash.
If you or a loved one has suffered serious injuries and property damage due to a distracted driving wreck, you may be able to recover compensation for losses related to the accident.

Great experience! Took care of pretty much everything, and I always felt like I want in good hands. Caroline Fa. was also a great help with everything. She always returned my calls and I never felt unheard. Even after my case she would still help me with my insurance documents.

Many companies talk about teamwork but few practice it. Many companies talk about an employee friendly environment but few actually provide it. At Phillips Law Group the foundation of our success is making sure we work as a team and that we work in an environment that allows everyone to thrive and be at their best every day. Our firm understands that in order for the client to have a great experience the people responsible for that client’s case must be given all the necessary tools and encouragement to make that happen. That’s the Phillips Way. As a manager of this firm in charge of several employees as well as directly affecting the client’s experience I take tremendous pride in saying we live by these premises and we work hard to build on them and make them better every day. This is an amazing place because it has amazing people working here!

Two family members were in a bad wreck a couple of years ago, and as a result called Phillips Law to represent them. Montana Thompson was the attorney assigned to the case with the help of Nemo Farr as legal assistant. Mr. Thompson litigated a very generous settlement for both my stepdaughter and her son. Because my grandson is a minor, I decided to act as conservator for him to ensure the settlement was safe and secure. Montana helped with that process, but it was Nemo who went way above and beyond the call in finding a financial institution to use for the restricted account. There were some glitches in that process but Nemo helped navigate them with a calm expertise which belies his age. I would consider them both great representatives of the level of commitment to their clients and assets to their firm.

My review is for Kathy Hudson a legal assistant at the law firm. She is great! She is very professional and a fair based person. She was never rude to me and always called me back. She listened to me and had my best interest as number 1. Mr Nasir who is a supervisor at law firm also was very professional and helpful. Not sure if spelling his name correctly but sorry if not. As far as mr Ross and the lady that runs the front desk reception I would say they are the most unprofessional and rude people I have met at a law firm in my life especially beings they were representing me. But Kathy made it overall a better experience. Thx Kathy.

Juan Roque has been integral with my legal needs. Communication has been easy. He conveys information I can easily understand without a lot of "Legal Fluff" jargon. I will certainly do business with Phillips Legal team again and refer them to my friends and family.

I have been with Phillips Law Group for a little over a year and I have learned what teamwork and family in a workplace looks like. There is always someone around to lend a helping hand, which is something I appreciate and cherish. I feel a sense of joy coming to work every day because of my co-workers as well as being able to help people in what can be a scary and stressful situation. I currently work as a Litigation Legal Assistant with an amazing team. When I started here, I was not very knowledgeable in personal injury. I was lucky to have been placed with an amazing team who was willing to take time to teach and pass on some great skills that have been a huge aid in helping me be successful in my position. I would recommend working here at Phillips Law Group, because they care about their employees and there is so much room for growth.
