Questions for Crash Victims
There are many questions your Phoenix-based vehicle accident lawyer may have for you when you contact him or her about representing you:
- Did another driver cause the accident?
- Could you be partially to blame?
- Have you been to the hospital or seen a doctor yet?
- What is your prognosis?
- Did you gather any evidence at the scene, such as pictures or statements from witnesses?
- Where were you going when the crash happened?
- What treatments have you undergone?
- Have you talked to the insurance company? If so, what did they ask you and what did you tell them?
- Did the insurance company make a settlement offer?
- Do you have any preexisting injuries?
- Does the police report indicate who may be at fault? Were any traffic citations issued?
What is Your Lawyer Trying to Find Out?
There is no way to know for sure if your claim will be successful. However, attorneys want to determine their odds of being successful. If your lawyer does not think he or she would be able to recover a favorable settlement, or at least recover more than you may be able to on your own, he or she may not take the case.
Your lawyer needs to know what may have caused the crash and how he or she may be able to prove it. In some cases, a lawyer may visit the scene to help him or her determine if there may be a case. Debris from the crash site, pictures of the damaged vehicle, and your account of events may help him or her determine the crash’s cause, such as:
- Speeding
- Distracted driving
- Tailgating
- Violating right-of-way laws
- Running a red light
- Driving the wrong way
- Drunk driving
The severity of your injury is also an important thing your attorney needs to know. If you have an injury that may take months to fully heal, or reach a point where it will no longer heal, you may have significant medical bills. In these types of situations, victims often struggle to obtain fair compensation on their own. An attorney may be able to help.
Even without your medical records, you can relay what the doctor told you and what you are experiencing each day.
If you have preexisting injuries, you should still be able to seek compensation. However, your lawyer needs to know so he or she can be prepared for the insurance company to bring it up.
It is typically a bad idea to say too much to the insurance company after a crash. Their interests are not the same as yours. However, your lawyer needs to know what you said. It is not that your comments may eliminate any chance of recovering compensation. Two family members were in a bad wreck a couple of years ago, and as a result called Phillips Law to represent them.
