Driver Killed in Two-Vehicle Distracted Driving Crash

A two-vehicle crash on the evening of Aug. 22 in Phoenix led to the death of one of the drivers.

According to Arizona Department of Public Safety (DPS), both cars were traveling west on Loop 101 in a construction zone when one vehicle struck the other from behind around 8:18 p.m. last Saturday.

The driver, David Justin Rivera, 21, of the car that was struck passed away at a nearby hospital from a traumatic brain injury (TBI). DPS arrested the driver, Brandon Moon, 23, who was driving the other vehicle.

Moon told authorities that he was using his phone prior to the accident. Investigators suspect that Moon was intoxicated as well. DPS conducted field sobriety tests, administered a breath test, and got a warrant to test his blood. The blood test led DPS to believe he was under the influence of Xanax at the time of the collision. Moon has been charged with aggravated assault causing serious physical injury and possession of a prescription drug.
